Terms of Work

1. Scope of Services

These terms apply to all design work commissioned through SPHERE RG, including but not limited to cover art, visual identity systems, artist branding, release campaigns, and merch design, as described on the relevant service package at the time of booking. The specific deliverables for your project are the ones listed under the package you selected (or agreed on directly), not an open-ended request for additional work.

2. Project Process

Projects generally follow this sequence:

1. Brief & references — you share the track/context, references, and intent.
2. Visual direction / concept — I return a direction (or a small set of directions) based on the brief.
3. Development — the chosen direction is developed into the final deliverables.
4. Revisions — feedback rounds, as included in your package (see below).
5. Delivery — final files are delivered once approved and paid in full.

Timelines are agreed per project before work begins and start counting from full receipt of brief materials (references, tracks, prior assets) and the upfront payment — not from the date of the initial conversation.

3. Payment

• 50% upfront payment before the project starts
• 50% after final approval, before delivering final files

4. Revisions

• 2 revision rounds are included
• Additional revisions may be billed separately if required

A revision round means feedback on the current direction, addressed in the next version. Requests that change the brief itself (new concept, different genre/mood, added deliverables) count as new scope, not a revision, and will be quoted separately.

5. Turnaround & Responsiveness

• Estimated delivery timelines assume feedback is returned within a reasonable window (typically a few business days per round).
• If a project goes unanswered for 14 days or more, it will be considered paused. Resuming it later may require re-confirming the current timeline and, for materially delayed projects, the current rate.

6. Usage Rights

• Full usage rights are granted after full payment
• The designer retains authorship rights

Until final payment is made, delivered previews and drafts are for review purposes only and may not be published, printed, or used commercially in any form.

7. Portfolio

• The designer may showcase the work in portfolio or social media
• If this is an issue, please notify in advance

8. Confidentiality

Unreleased music, embargoed release dates, and any materials shared in confidence (rough mixes, unannounced artist names, campaign plans) are treated as confidential and will not be shared, posted, or referenced publicly before the agreed release date, unless already made public by the client.

9. File Delivery

• Final files are delivered in the formats specified in your package (e.g. high-resolution master, platform-specific adaptations, layered source files where included).
• Files are delivered once, in the agreed format. Requests for additional formats, resolutions, or re-exports outside the original scope may be billed separately.
• Please keep your own backup of delivered files. Re-sending lost files after project close may incur a small retrieval fee.

10. Cancellation

• If the project is cancelled after the sketch/concept stage, the upfront payment is non-refundable and covers the work already completed
• If the project is cancelled before any concept work has started, the upfront payment may be refunded at the designer's discretion, minus any time already spent on the brief/research stage

11. Limitation of Liability

Design work is provided on a professional best-effort basis. SPHERE RG is not liable for indirect losses (e.g. lost revenue, delayed release schedules, third-party platform rejections) arising from the use of delivered work. Total liability for any project is limited to the amount paid for that project.

12. Force Majeure

Neither party is responsible for delays caused by circumstances beyond reasonable control (illness, technical failures, events beyond either party's control). Affected timelines will be adjusted in good faith.

13. Governing Law

These terms are governed by the laws of Ukraine. Any disputes will be handled under that jurisdiction.

14. Changes to These Terms

These terms may be updated from time to time. The version in effect at the time your project begins (upfront payment received) is the one that applies to that project.

15. Acceptance

By submitting a project brief and/or making the upfront payment, you confirm that you have read and agree to these terms.
